CGU

PREAMBLE 

These terms and conditions of use apply to every holder of the Pass Avantages Pays de Saint Jean de Monts. The Pass is implemented and managed by SPL Océan Marais de Monts Tourisme, registered under number 82926526300014, with its head office located at 46 rue de la Paix – 85160 Saint Jean de Monts.

ARTICLE 1 – DESCRIPTION 

The Pass Avantages Pays de Saint Jean de Monts offers discounts on various leisure activities and tourist sites, intended for both visitors and local residents. 

It is presented as a unique digital support, numbered and associated with a QR code. The Pass is nominative and requires a valid email address for technical, statistical, and GDPR tracking purposes. 

The Pass is valid for the holder and up to five accompanying persons, allowing a maximum of six people to benefit from the discounts. 

It provides discounted rates on a range of leisure activities and tourist sites listed on the website https://pass.paysdesaintjeandemonts.fr/lang/en, subject to the conditions defined herein.

ARTICLE 2 – PURPOSE 

These terms and conditions of use (TCU) define the rights and obligations of the parties concerning the use of the Pass Avantages Pays de Saint Jean de Monts. 

They constitute the pre-contractual information required by Articles L.111-1 and following of the Consumer Code. 

Before creating the Pass, the beneficiary agrees to read and accept these TCU without reservation.  

The specific conditions of partner sites are separate and are their sole responsibility. These are clearly communicated to the beneficiary. 

Therefore, these TCU only concern the use of the Pass and not the specific conditions of the partner providers themselves. Each tourism professional freely organises their access, opening, and operating conditions.

ARTICLE 3 – SCOPE AND DURATION OF APPLICATION 

The Pass is valid from 1 January to 31 December of the calendar year. Beyond this date, it automatically becomes inactive. Unused benefits are neither carried over nor refunded.

ARTICLE 4 – ENFORCEABILITY OF THE TERMS AND CONDITIONS OF USE 

The applicable version of the TCU is the one accepted at the time of ordering. The TCU are archived by date by SPL Océan Marais de Monts Tourisme. Any updates will be notified to the beneficiary and partners as soon as possible by SPL Océan Marais de Monts Tourisme. 

ARTICLE 5 – CREATION OF THE PASS 

The Pass can be created directly on the website https://pass.paysdesaintjeandemonts.fr/lang/en or via the Pass Avantages PSJDM mobile application. It is also possible to create it at a distribution point indicated by SPL Océan Marais de Monts Tourisme. The list of distribution points is available on the Pass website. 

The entry of certain personal data is mandatory to validate the creation and use of the Pass. Without this, the creation of the Pass cannot be validated.

ARTICLE 6 – PRICE 

The Pass is free of charge. Its offer includes discounts with partner providers of the operation, applicable under various conditions (limited to six beneficiaries per Pass). It includes the provision of a QR code (via a PDF document sent by email). The user can choose to download the accompanying mobile application or consult the Pass website.

ARTICLE 7 – PRESENTATION AND TERMS OF USE 

The Pass consists of a PDF document (printable or downloadable to a computer, tablet, or mobile phone). This document is sent by email and includes a QR code, a unique 8-digit code, and three specific promotional codes corresponding to the three types of offers included in the Pass, to be provided to partner professionals at the time of booking. 

The beneficiary can download the Pass Avantages mobile application and enter the 8-digit code of their Pass or scan it to register. 

The Pass must be presented before each visit to validate the discount with the concerned partner site. 

The Pass does not constitute a skip-the-line ticket and does not guarantee availability or access to any events offered by the sites. 

The Pass can be presented multiple times at partner sites during its validity period, except at the Saint Jean de Monts Nautical Base. 

Upon registration, certain personal data of the user will be collected. 

Within minutes of registration, the Pass is sent by email and can be used immediately. 

The Pass is personal and non-transferable. Its multiple use is permitted within the specific conditions. 

In case of non-use of all or part of the discounts included in the Pass within the described deadlines, no fees of any kind can be claimed as reimbursement or compensation. 

In the event of force majeure related to health issues, administrative closures, etc., no reimbursement or compensation is provided. 

The opening hours of each partner site are under the responsibility of the site itself and are indicated for information purposes on the Pass website. 

The list of partners is subject to change and is non-contractual. The holder is invited to check the reception conditions directly with the partners.

ARTICLE 8 – INFORMATION SUPPORTS 

Upon creation of the Pass, an email is sent to the user allowing them to download their Pass in its digital version (PDF). This email indicates the website and mobile application of the Pass listing the partner sites of the operation in real time. 

The website provides the Pass holder with the following information about partner sites: address, phone number, website, public opening days and hours, and rates. 

The information on the website and application is current at the time of publication and may be subject to changes (modifications of hours, rates, closures, withdrawal of a professional from the Pass Avantages operation, etc.). 

During the season, a provider may decide to no longer offer offers. 

Despite all the care taken in its creation, the website and application may contain errors for which SPL Océan Marais de Monts Tourisme cannot be held responsible (non-contractual information). The information comes notably from the TOURINSOFT database, managed by Vendée Expansion, in partnership with tourist offices and in connection with the professionals concerned. 

In case of non-compliance with contractual obligations or force majeure, SPL Océan Marais de Monts Tourisme reserves the right to terminate the partnership with a partner site and remove the concerned services from the Pass offer, without the holder being entitled to any compensation or refund. 

The partner site commits to promptly inform SPL Océan Marais de Monts Tourisme of any changes related to the proper information of Pass holders: reception conditions, opening days and hours, exceptional or permanent closures, rates. 

In case of modification, the partner commits to update their TOURINSOFT record so that the information is correctly reflected on the Pass website and mobile application. 

SPL Océan Marais de Monts Tourisme cannot be held responsible for changes inherent to the reception conditions of a partner site that prevent the proper execution of the services offered under the Pass. 

Before any visit, it is recommended that the Pass holder directly contacts the partner site to confirm opening days and hours.

ARTICLE 9 – MALFUNCTION, LOSS, OR THEFT 

In case of a technical malfunction of the Pass preventing the validation of the code or QR code when accessing a partner site, the holder is invited to inform SPL Océan Marais de Monts as soon as possible to proceed with a replacement by email at accueil.sjdm@paysdesaintjeandemonts.fr or by phone at +33(0)2 72 78 80 80. 

SPL cannot be held responsible for malfunctions related to the user's equipment (device, internet connection, etc.).

ARTICLE 10 – PERSONAL DATA 

Data is collected in compliance with GDPR. The personal information collected is limited to the data strictly necessary for the Pass request to verify the beneficiary's identity. 

The data may be used by SPL Océan Marais de Monts Tourisme and its partners for the issuance of the Pass, statistical analysis of Pass usage, and commercial prospecting. 

The Pass holder can exercise their rights of access and rectification concerning their information under the conditions provided by Law No. 78-17 of 6 January 1978 by contacting SPL Océan Marais de Monts Tourisme: 

  • By mail: SPL Océan Marais de Monts Tourisme – 67 Esplanade de la Mer – 85160 Saint Jean de Monts 

The information collected is recorded in a computer file managed by SPL Océan Marais de Monts Tourisme. This data will be used to send the Pass, updates, satisfaction surveys, newsletters promoting the Pays de Saint Jean de Monts, and to compile attendance statistics. 

The data is backed up daily on a secure storage space connected to the website https://pass.paysdesaintjeandemonts.fr/lang/en, managed by the company OTIpass. It will be retained for the duration necessary to achieve the intended purpose, up to a maximum of 18 months after the last contact between the two parties.

ARTICLE 12 – APPLICABLE LAW – DISPUTES 

In the event of a dispute, the parties may resort to conventional mediation or an alternative dispute resolution procedure. 

Failing that, the competent courts shall be those of the location where the service is performed.
